12/21/09 - Bid Certifying Statement: No requirement to provide equipment or services.

Saturday afternoon, December 19th, 3:00 P.M.

I just finished double checking all of the Form B subsections: Revenue from Product Category, Top HCPCS Codes, Expansion Plan, Bid Sheet, Manufacturer Model Numbers and Summary Page. All that remained was to certify the bid.

 

The Certification Statement asks that:

I have read the contents of this application.

I have examined the completed application and accompanying financial statements.

I certify that they are true, correct, and complete and can be substantiated from our books and records.

I certify that the information contained herein is true, correct, and complete to the best of my knowledge, and I authorize the Competitive Bidding Implementation Contractor (CBIC) to verify this information.

But the Certification statement never asks if:

I intend to deliver and service the equipment and supplies of the bidding program.

I am able deliver and service the equipment and supplies at the price that I bid.

I am able to operate my business at the price that I bid at.

I will accept the price I entered if I am awarded the bid contract.

For anyone who has completed a bid, spent thousands of dollars on credit reports, accountants and consultants, wasted hundreds of man hours preparing and entering information in the Dbids program, understand this:

Even with the MIPPA changes, the fundamental flaw of the DMEPOS Bidding program still remains: This is still a bid without financial accountability. Companies enter bids that they are not required to perform, but after they walk away (without penalty), everyone else in the Competitive Bidding Area is stuck with their price. The lack of financial accountability makes the bid you just submitted irrelevant and that is the primary reason Congress must repeal this flawed program.
